REGULAR BOARD MEETING
January 11, 2010
The Regular Board Meeting of the Town Board of the Town of Royalton was held on Monday, January 11, 2010, at the Royalton Town Hall, 5316 Royalton Center Road, Middleport, New York. The meeting was called to order by Supervisor Richard J. Lang at 7:30 PM. The pledge to the flag was recited at the Organizational Meeting immediately preceding this meeting.

ADDITIONS OR CORRECTIONS TO THE MINUTES
There were no additions or corrections to be made to the minutes as presented by the Town Clerk.
PUBLIC COMMENT
Ms. Molly McGirr asked about the resolution for the Official Undertaking. Town Clerk Little stated that we were informed that this needed to be passed by the town board and kept on file in our offices. This is listed in the Public Officers Law handbook.
NEW BUSINESS
RESOLUTION 21-10
BID ACCEPTANCE FOR NEW EXCAVATOR
On a motion made by Councilwoman Bieber, seconded by Councilman Rehwaldt, the following resolution was

Resolved to accept the bid from Vantage Equipment, LLC in the amount of $157,413.00 - $17,000.00 trade-in allowance = $140,413.00 for the 2010 Excavator, Make - Volvo, Model #EC210C. Bid amount not to exceed $140,413.00. This was the only bid that met all of the bid specifications. The bids received are as follows:

NIAGARA COUMMUNITY ACTION PROGRAM ANNUAL CONTRACT
On a motion made by Councilwoman Bieber, seconded by Councilman Budde, the following resolution was

Resolved to authorize Supervisor Lang to sign the contract with the Niagara Community Action Program (NIACAP) for 2010 in the amount of $1,500.00. This program helps to benefit residents in our community.

Resolved to authorize Supervisor Richard J. Lang to negotiate an agreement with the Town of Hartland to utilize a shared Assessor for both towns.

OFFICIAL UNDERTAKING FOR THE TOWN OF ROYALTON
On a motion made by Councilman Rehwaldt, seconded by Councilman Bragg, the following resolution was

Resolution to adopt the OFFICIAL UNDERTAKING OF MUNICIPAL OFFICIALS
WHEREAS, various sections of New York State Town Law and Public Officers Law require that certain officials
execute an Official Undertaking; and
WHEREAS, we, the Town Board of the Town of Royalton hereby require the Supervisor, Town Clerk, Tax Collector, Town Justice(s), and Highway Superintendent to execute said Official Undertaking as required by said law;
NOW, THEREFORE BE IT RESOLVED that we, the Town Board of the Town of Royalton approve the document entitled "Town of Royalton Official Undertaking of Municipal Officers" as to its form and manner of execution and the sufficiency of the insurance, and
BE IT FURTHER RESOLVED that said Official Undertaking containing the notarized signatures of those named municipal officials be filed in the Office of the Town Clerk, as well as the original copies of the insurance policies indicating the sufficiency of the sureties to indemnify the Town against losses which may arise from failure of such officials to properly discharge their duties.

Resolved to appoint Town Clerk Marie L. Little, RMC, as the voting delegate at the Annual Association of Towns Meeting; be it FURTHER RESOLVED to appoint Attorney Thomas Brandt to act as the alternate voting delegate at said meeting.

Resolved that the Town Clerk be and she hereby is authorized to draw a warrant upon the funds of the Supervisor in the amount of $48,445.33covering vouchers #1452 - 1477 for Abstract #14 for the year 2009 for the Town Hall, Highway Department and the Water / Sewer Department. BE IT FURTHER RESOLVED that the Town Clerk be and she hereby is authorized to draw a warrant upon the funds of the Supervisor in the amount of $55,574.96 covering vouchers #1 - 13 for the year 2010 for the Town Hall, Highway Department and the Water / Sewer Department.

There was no unfinished business to come before the board at this time.
PUBLIC COMMENT - GOOD & WELFARE OF THE COMMUNITY
There was no Public Comment to come before the board at this time.
A motion was made by Councilwoman Bieber, seconded by Councilman Budde, and carried unanimously that the board convene in to an Executive Session at 7:20 PM for the purpose of discussing the "medical, financial, credit or employment history of a particular person or corporation, or relating to appointment, promotion, demotion, discipline or removal".
Town Clerk Little performed the official "Oath of Office" ceremony for those individuals present who were appointed to the various positions passed by resolution this evening.

EXECUTIVE SESSION
Present: Supervisor Lang, Deputy Supervisor Bieber, Councilman Bragg, Councilman Budde, Councilman Rehwaldt,
Attorney Brandt
The town board members held their Executive Session discussion in the Supervisors office. There was no formal action taken at this time. There being no further information to come before this board, a motion was made by Councilwoman Bieber, seconded by Councilman Rehwaldt and carried unanimously that the Executive Session be adjourned at 8:34 PM and that they reconvene to the Regular Board Meeting.
